Personal Injury Law | Head Injury, Traumatic Brain Injury & Brain Damage

Head and Brain Injury | Brain Damage

There are two general types of head injury: Traumatic Brain Injury,  and Acquired Brain Injury. Most people recover naturally from a mild traumatic brain injury.  Some people who experience mild injury don't recover.  If your injury is permanent, even if mild, the consequences and results are life-changing.

Symptoms:

The victim may experience personality changes, mood swings, loss of short-term and long-term memory, fatigue and difficulty concentrating, headaches.  Their judgement may be impaired.   Imagine waking up one day finding it impossible to make up your mind about even simple choices.

Head and Brain Injury, Brain Damage and Traumatic Brain Injury (TBI) and its associated symptoms can be difficult to deal with.  You find yourself unable to work.  You don't get along with your boss.  You don't like your co-workers.  You feel cranky.  You always had a great relationship with your spouse, your family members, and now you don't.  You get into arguments.  You raise your voice.  You break things to relieve your frustration.   We realize this all sounds extreme - if you aren't experiencing such severe symptoms, you are blessed.  But severe headaches all the time are their own form of hell.

Many people with Traumatic Brain Injuries do not realize what is happening to them. Simple tasks are hard and complex tasks can become impossible, and they don't realize it is a result of their accident.  How can that be?  They may feel like they are going crazy. Dealing with family and friends has become difficult. As a result, Traumatic Brain Injury causes additional emotional strain to the family. Caring for someone with a brain affliction can be challenging and extremely expensive.

The attorneys at Leonard Moen & Associates, with over 60 years of combined experience, deal knowledgeably and sensitively with people who have Traumatic Brain Injury and other serious head injuries. We have resources to assist you and your loved ones with the devastation and loss associated with Traumatic Brian Injury. Your legal case and your emotional trauma are something we understand and can help you deal with.

Most Traumatic Brain Injuries and serious brain damage we deal with are accident related. For example, many car crash victims and motorcycle crash victims experience head injury as well as physical injuries. Many clients are not aware they have a head injury and do not understand their personality changes, cognitive difficulties and the troubles in their relationships they experience. The attorneys at Leonard Moen & Associates are experienced in working with brain injured clients, their families, and medical team.

Many things will determine whether the head injury was caused by someone else's negligence. Cause of the injury, medical documentation and expert opinions are essential in order to obtain full and necessary compensation.

Leonard Moen & Associates, Case Review: (Mild Traumatic Brain Injury/Severe Concussion)

Traumatic Brain Injury | Serious Head Injury

Traumatic Brain Injury occurs when a sudden trauma causes damage to the brain, usually as a result of a motor vehicle collision, sports accident, blunt force trauma or serious fall. The damage can be confined to one area of the brain, or involve several areas.

The outcome of injury to the brain can range from complete recovery to permanent disability, coma or death. No two brain injuries are exactly the same. For example; about 18 months after her accident, one of our clients has nearly recovered, has repaired her relationship with her husband and has resumed a normal life. Another client, almost three and a half years after the event, is still struggling with memory, organization, multi-tasking and deteriorating relationships. He is learning compensation techniques, but his doctors consider his brain injury to be permanent. His compensation for his injury was significant.

Traumatic Brain Injuries are often a permanent, life-changing event. The victim may never be the same again. The costs can be astronomical: emotionally, financially, and socially.

There can be many side effects and upsetting behavior in the injured person caused by Traumatic Brain Injury (One of our clients experienced sudden and atypical anger towards her husband after her head injury).

The symptoms of TBI can include, but are not limited to the following physical, cognitive and emotional consequences:

  • Behavior and personality changes | such as impulsive behavior, increased agitation and reduced anger thresholds
  • Coma
  • Concentration problems and problems completing tasks
  • Concussion
  • Depression and anxiety | Severe mood swings
  • Difficulty multi-tasking | Inability to perform career related tasks
  • Equilibrium and balance problems | Spatial disorientation
  • Headaches, vomiting and nausea
  • Impaired reasoning skills | Inability to plan or solve problems
  • Impaired speech and difficulty communicating | Inability to find words or carry on a conversation
  • Loss of sensory awareness, such as touch, taste or smell
  • Paralysis | Partial or total
  • Post Traumatic Stress Disorder (PTSD)
  • Seizure and spasms
  • Short-term or long-term loss of memory
  • Vision impairment | Double vision, blurred vision or total blindness

Acquired Brain Injury

Acquired Brain Injury is often associated with medical negligence. It occurs when there is a deficiency in the body, such as a lack of oxygen to the brain.

Advocates Of Your Rights

When you consult with Leonard Moen & Associates, we will explain the legal process, and work with you to explore whether or not you need an attorney.

Many times, people who experience a personal injury have other issues that do not, at first, seem related. Following a trauma, it is not unusual to experience anxiety, depression, anger issues, and problems sleeping, weight loss and emotional stress. This is normal. Please discuss these symptoms with your attorney and your treating physician.

Payment of medical bills, loss of income, compensation for pain and suffering and other damages are the main concerns of families and individuals who have been injured. Life long changes, continuous medical care requirements and lengthy treatment programs can be financially ruinous. Our team of legal professionals knows how to negotiate these issues with the insurance companies to insure you and your family get the compensation you are entitled to; and to successfully sue to obtain fair compensation if negotiations fail.

A reputable personal injury lawyer will tell you whether a claim is too small to justify the expense of an attorney.
